Homestead Helmet Law
In Florida, motorcyclists must abide by helmet laws. By law, passengers and motorcyclist are required to wear helmets unless the motorcyclist is over a specific age and has a specific amount of insurance. Homestead motorcyclists depend on their helmets to keep them safe and protect them from head injuries – one of the leading causes of serious injury and fatalities in motorcycle collisions.
If you have been injured in a motorcycle accident in Homestead or another South Florida community and you believe your injuries may have been caused by a defective helmet or if you think you may have another type of legal claim, contact Flaxman Law Group to arrange for a free case evaluation. Under Florida law, motorcyclists must wear helmets unless they are 21 years of age and have $10,000 or more in medical insurance coverage on their vehicle insurance policy. According to Section 1. Subsection (3) of section 316.211, Florida Statutes, all passengers under the age of 16 must wear a helmet at all times. These laws apply to both anyone who is a Florida resident and to anyone who is visiting Homestead or the state and riding their bike.
While motorcyclists are often able to avoid wearing a helmet in Florida simply by having enough insurance and by being at least 21 years of age, it is important to keep in mind that many head injury patients in Homestead who have been injured in a traffic accident or bicycle accident have sustained their injuries because they were not wearing a helmet. Virtually all medical experts agree that wearing a helmet is one of the best ways to safeguard against traumatic brain injury, which is a leading cause of death for motorcyclists injured in traffic accidents.Preventing Head Injuries
Even if you do not have to wear a helmet, because you are exempt under Florida law, it is an excellent idea to always wear the proper helmet each time you hop on your motorcycle. It allows you to enjoy the freedom of the road but also allows you to stay a little bit safer. It could save your life.
