Helmet Laws in Hollywood and Florida

According to Section 1. Subsection (3) of section 316.211, Florida Statutes, motorcycle riders and passengers must wear a helmet with one exception: “a person over 21 years of age may operate or ride upon a motorcycle without wearing protective headgear securely fastened upon his or her head if such person is covered by an insurance policy providing for at least $10,000 in medical benefits for injuries incurred as a result of a crash while operating or riding on a motorcycle.” Younger passengers, however, are required to wear protective gear: “No person under 16 years of age shall operate or ride upon a moped unless the person is properly wearing protective headgear securely fastened upon his or her head which complies with standards established by the department.”

Under Florida laws, you must wear a helmet whether you are a resident of the state or just visiting – unless you meet the exception requirements. To wear a novelty helmet that does not meet safety requirements you must also meet the exception requirements.

Florida helmet laws mean that riders and passengers can ride a motorcycle without a helmet in some cases.
