Hollywood Helmet Law

Safety experts agree that motorcycle helmets are one of the best ways to prevent head injuries in any motorcycle accident. If you ride a motorcycle in Hollywood or in any community, you will want to wear a helmet every time you ride in order to prevent injury.

If your motorcycle helmet is defective and this has caused a head injury for you or if you believe that your motorcycle accident injuries were caused by someone's negligence or recklessness, you may have a legal claim. Under Florida law, you may have the right to pursue compensation for lost income, medical bills, and other costs related to your accident. Helmet Laws in Hollywood and Florida

According to Section 1. Subsection (3) of section 316.211, Florida Statutes, motorcycle riders and passengers must wear a helmet with one exception: “a person over 21 years of age may operate or ride upon a motorcycle without wearing protective headgear securely fastened upon his or her head if such person is covered by an insurance policy providing for at least $10,000 in medical benefits for injuries incurred as a result of a crash while operating or riding on a motorcycle.” Younger passengers, however, are required to wear protective gear: “No person under 16 years of age shall operate or ride upon a moped unless the person is properly wearing protective headgear securely fastened upon his or her head which complies with standards established by the department.”

Under Florida laws, you must wear a helmet whether you are a resident of the state or just visiting – unless you meet the exception requirements. To wear a novelty helmet that does not meet safety requirements you must also meet the exception requirements.

Prevent Head Injuries in Hollywood by Wearing a Helmet

Florida helmet laws mean that riders and passengers can ride a motorcycle without a helmet in some cases. This is despite the fact that safety experts agree that helmets are the best way to prevent a serious head injury – one of the most common causes of fatalities and serious injuries in a motorcycle accident. Even though you may be exempt from wearing a helmet under Florida law, it is best to wear one anyway. It could save your life.

If you are in a motorcycle accident and are seriously injured due to a defective helmet or because you were not wearing a helmet, you may have a legal claim if your injuries were caused by someone’s recklessness and negligence.
